ProTECHtion Terms of Use

Protechtion, LLC and/or its affiliates ("Protechtion"), is composed of the Protechtion web site, www.protechtion.net (the "Protechtion Site"), and any other web site, product or service owned or operated by or on behalf of Protechtion (each individually, a "Protechtion Property" and collectively, the "Protechtion Properties"). By accessing or using any Protechtion Property, you agree to be bound by these Terms of Use (these "Terms of Use"), our Privacy Policy and, where applicable, an End User License Agreement and any terms specific to such Protechtion Property. If you do not agree with our policies, please do not access the Protechtion Site or use any Protechtion Property. Please read these Terms of Use carefully.

The Protechtion Properties are always evolving, so you should periodically check here, as well as the specific rules for any games or activities in which you choose to participate, for updates. We reserve the right to make changes to these Terms of Use at any time by posting the changes on the Protechtion Site. If there is a conflict between these Terms of Use and any other rules or instructions posted on or in a Protechtion Property, these Terms of Use will control.

GAME TOURNAMENT PARTICIPATION

Any college or high school contestant must submit enrollment verification of the educational institution they are attending before they can officially compete in the final event for any scholarship prizes. Verification will be confirmed with the educational institution. Failure of verification will result in disqualification.

Scholarship money will be sent directly to the educational institution the contestant is currently or will be attending. Contestant must submit documentation to whom the scholarship funds will be forwarded to at their educational institution.

ELECTRONIC COMMUNICATIONS

When you visit the Protechtion Site, send e-mails or electronically chat with us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on the Protechtion Site. You agree that all agreements, notices, disclosures and other communications that Protechtion provides to you electronically satisfy any legal requirement that such communications be in writing.

Protechtion may provide notice to You via email, regular mail, or posting notices or links to notices on the Website. Protechtion reserves the right at any time to modify, suspend or terminate the Services (or any part thereof), and/or Your use of or access to them, with or without notice. Protechtion may also delete, or bar access to or use of, all related Information and files. Protechtion will not be liable to You or any third-party for any modification, suspension, or termination of the Services, or loss of related information. Protechtion may amend these Terms at any time by posting the amended terms on this Website.

ACCOUNTS

If you create an account on the Protechtion Site, you are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur with respect to your account. You agree to indemnify and hold Protechtion and its affiliates, agents, suppliers, alliance members, other partners, employees and representatives harmless for any improper or illegal use of your account. This includes illegal or improper use by someone to whom you have given permission to use your account or whom you have negligently allowed to access your account. Protechtion reserves the right to terminate your account if any activity that occurs with respect to your account violates these Terms of Use. Protechtion reserves the right to limit the number of accounts a user can establish.

ONLINE CONTENT

You may submit suggestions, ideas, questions or other information on the Protechtion Site, as long as the content you post is not: (a) illegal, harmful, obscene, pornographic, racist, violent, offensive, harassing, threatening, defamatory, invasive of privacy, otherwise injurious to third parties or objectionable to Protechtion or other users of the website, (b)includes disclosure of personal information, or (c) violates or infringes anyone's intellectual property rights. You agree not to upload material which contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, political campaigning, pyramid schemes, chain letters, mass mailings, or any form of "spam". You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead other users as to the origin of any content you post. Protechtion reserves the right, but not the obligation, to remove or edit such content, but does not review all posted content.

If you do post content or submit material, and unless we indicate otherwise, you grant Protechtion a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such content throughout the world in any media. You grant Protechtion and its sub licensees the right to use the name that you submit in connection with such content, if we and/or they choose. You represent and warrant that you own or otherwise control all of the rights to your posted content, that the content is accurate, that use of the posted content does not violate these Terms of Use and will not cause injury to any person or entity, and that you will indemnify Protechtion for all claims resulting from your posted content.

PROTECHTION HAS THE RIGHT, BUT NOT THE OBLIGATION, TO MONITOR AND EDIT OR REMOVE ANY ACTIVITY OR CONTENT THAT IT DEEMS OBJECTIONABLE IN ITS SOLE DISCRETION AND/OR THAT VIOLATES THESE TERMS OF USE. PROTECHTION TAKES NO RESPONSIBILITY AND ASSUMES NO LIABILITY FOR ANY CONTENT POSTED BY YOU OR ANY THIRD PARTY.

COMMERCIAL ACTIVITY AND UNSOLICITED EMAIL

You may not use any area of the Protechtion Site or any other Protechtion Property to collect information, including login names, about any Protechtion users, and use of such information to send unsolicited email or for any other purpose is strictly prohibited. You may not exploit any Protechtion Property, including without limitation, the Protechtion Site, or services offered on the Protechtion Site or any other Protechtion Property for any commercial purpose.

ADVERTISEMENTS AND PROMOTIONS

Protechtion runs advertisements and promotions from third parties on the Website. Your correspondence or business dealings with, or participation in promotions of, advertisers other than Protechtion found on or through the Website, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between You and such advertiser. Protechtion is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such non-Protechtion advertisers on the Website.

LICENSE AND SITE ACCESS

Protechtion grants you a limited license to access and make personal use of the Protechtion Site. Neither the Protechtion Site nor any portion of it may be reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any commercial purpose without Protechtion's express written consent. You may not use any content posted on the Protechtion Site or any other Protechtion Property, any Protechtion logo, or any other proprietary graphic or trademark of Protechtion without our express written consent. Any violation of these obligations terminates the license granted by Protechtion for you to make personal use of the Protechtion Site.

Most of the content available on the Protechtion Site is owned by Protechtion or our licensors, and is protected by United States and international copyright, trademark, and other intellectual property rights. The compilation of all content on the Protechtion Site is the exclusive property of Protechtion and is protected by United States and international copyright laws. TERMINATION OF ANY PROTECHTION ACCOUNT

Protechtion and you each have the right to terminate or cancel any account you have created at any time for any reason. You understand and agree that the cancellation of your account or a particular account is your sole right and remedy with respect to any dispute with Protechtion. This includes, but is not limited to, any dispute related to, or arising out of: (1) any term of these Terms of Use or Protechtion's enforcement or application of these Terms of Use; (2) any of the content available on or through any Protechtion Property, including, without limitation, the Protechtion Site, any change in any such content; (3) your ability to access and/or use any Protechtion Property, including, without limitation, the Protechtion Site; or (4) the amount or type of any fees, surcharges, applicable taxes, billing methods, or any change to the fees, applicable taxes, surcharges or billing methods, in each case imposed or implemented by Protechtion on or through any Protechtion Property, including, without limitation, the Protechtion Site.

Protechtion reserves the right to collect fees, surcharges or costs incurred before you cancel your account. In the event that your account is terminated or canceled, no refund will be granted.

Without limiting the foregoing provisions, if you violate these Terms of Use, Protechtion may issue you a warning regarding the violation, or, in Protechtion's sole discretion, immediately terminate any and all accounts that you have established on the Protechtion Site or on or through any other Protechtion Property, with or without notice.

DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY

YOUR USE OF THIS WEB SITE IS AT YOUR SOLE RISK. THE PROTECHTION SITE AND ALL OTHER PROTECHTION PROPERTIES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. PROTECHTION MAKES NO REPRESENTATION OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. PROTECHTION DOES NOT WARRANT THAT THE PROTECHTION SITE, ANY OTHER PROTECHTION PROPERTY, ANY NEWSLETTERS OR ANY E-MAILS SENT FROM PROTECHTION ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS, AND PROTECHTION MAKES NO WARRANTIES AS TO THE OPERATION OF THE PROTECHTION SITE.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

PROTECHTION'S PRIVACY POLICY

You consent to the collection, processing and storage by Protechtion of Your personal information in accordance with the terms of Protection's Privacy Policy. You agree to comply with all applicable laws and regulations, and the terms of Protechtion's Privacy Policy, with respect to any access, use and/or submission by You of any personal information in connection with this Website.
